Terms and Conditions

Article 1 (Terms of Service)

This agreement shall apply when customers use “myMakino” operated by Makino Asia Pte Ltd. (hereinafter referred to as “Our Company”).

1.Definition In these Terms of Use, the following Terms shall be defined as follows:

“Site” means the Members-only website “myMakino” operated by Our Company.
"Service" means the Web Services on this Site. The Service includes the following series of Services. View a list of Member-owned products on this Site. View the Purchase Histories of parts from Our Company on this Site. View usage of various services related to Our Company's products on this Site View support information for Our Company's products. View web manuals for Our Company's products related to Our Company's Products on this Site. View FAQs (frequently asked questions and answers) and other information on this Site.
"Member" means a customer who has purchased Our Company's Products and who has registered as a member in accordance with the provisions of Article 2 of this Terms of Service.

Article 2 (Establishment of the Terms of Use of this Service)

Customers who have purchased Our Company's products apply for the use of this Service in accordance with the procedures prescribed by Our Company, and we register those customers who have been approved by Our Company as Members.

Article 3 (Conditions for using this Service)

Members may use our Service FREE OF CHARGE.
Members shall prepare and maintain the communication lines, terminal equipment, and other equipment necessary for using this Service at their own responsibility and expense.

Article 4 (Account Assignment, Management, etc.)

In order to use this Service, Members shall designate a Site Administrator and notify Our Company. Our Company shall assign a Site Administrator ID to the relevant Site Administrator.
In order to use this Service, the Site Administrator ID can assign Administrator ID and User ID to member employees (including temporary employees and other employees who perform member work) according to the provisions of the preceding paragraph. The person who has obtained the Administrator ID can provide User ID to other employees.
Members and employees who have been given Site Administrator ID, Administrator ID and User ID shall strictly manage IDs and passwords for using this service at their own responsibility. It shall not be allowed to be used by others, or it shall not be lent, transferred, traded, etc.
Members are responsible for damage by themself which caused by inadequate management of ID and Password, errors in use, use by third parties, etc., and Our Company Shall not be liable for any such damage.
If you are logged in to this Site by entering the ID and password registered in accordance with this article (including cases where you have been given an Administrator ID or user ID by the Site Administrator), a person with legitimate authority may access this Site. Any and all liabilities arising from or in connection with such use of this Site shall be the sole responsibility of the Member.

Article 5 (Access Log/History Information)

This Site records information such as the domain name of the person accessing the website, the type of browser being used, and the date (including time) of access in the form of access logs, but the access logs do not contain information that can identify individuals. The access logs will be only used for website maintenance and statistical of usage, and Our Company will not use them for any other purpose.

Article 6 (Handling of personal information in this Service)

The handling of personal information in this Service shall be in accordance with the privacy policy separately established by Our Company.

Article 7 (Intellectual property rights, etc.)

The copyrights to all documents, images, illustrations, video, audio, data, software, etc. (hereinafter referred to as the “Contents”) posted on this Site belong to Our Company and its affiliates. These Contents may not be copied, modified, adapted, transferred, reprinted, or publicly transmitted without the permission of the Copyright Holder. If individual Content is provided with individual Terms of Use by the Copyright Holder, the Member shall also comply with such Terms of Use.
All rights to the trademarks, logs, and trade names appearing on this Site are the property of Our Company and its affiliates or their respective owners. These rights may not be used without permission.
Our Company do not grant any rights based on copyrights, patent rights, trademark rights, or other intellectual property rights with respect to the Contents on this Site.
In the event that the intellectual property rights of the Company or a third party are infringed, the Company may take countermeasures against such infringement based on law (including but not limited to seeking an injunction).
Members (including a Member Employee who has Site Administrator ID, Administrator ID or User ID in accordance with Article 4) shall comply with the "Foreign Exchange and Foreign Trade Act" and other applicable laws and regulations when exporting (or provide to non-residents user) technical information (including but not limited to information necessary for design, manufacture or use) provided on this Site or products purchased by Members.

Article 8 (About Links)

Link to this Site In the event when a member has set a link to this Site on a website other than this Site, if Our Company determines that the link is inappropriate, the Member shall cancel the setting of the link at the request of Our Company. When setting a link to this Site, the notation of Our Company name shall be “Makino Asia Pte Ltd”.
Links from this Site Even if the Site contains links to third-party websites, such links are provided for convenience only and Our Company are not responsible for any results of the Member’s use of the linked websites.

Article 9 (Prohibited Acts)

Members shall not engage in any of the following acts when using the Service.

Actions that violate or may violate laws and regulations or these Term of Use
Acts contrary to public order and morals
Acts that obstruct or may obstruct the use of other Members
Unauthorized access to the software that constitutes the Service, cracking, or other acts that interfere with facilities, etc.
Acts of illegally using ID and password, or acts of disclosing, transferring, setting security interests, or otherwise disposing of ID and password to third parties
Acts that obstruct or may obstruct the operation of this Site or the provision of this Site
Acts that damage or may damage the reputation of Our Company or the Service
Acts of lending, transferring, setting a security interest, or otherwise disposing of the Tangible and Intangible Components (including software programs, databases, icons, images, texts, related documents such as manuals, know-how, etc.) that make up the Service to a third party
Analyze, reverse engineer, decompile or disassemble, copy/modify, adapt, edit, create derivative works from, or disclose the source code or algorithms of all or part of the software that constitutes Our Service
Acts of using this Service for purposes other than the purpose and method of use of this Service
Other acts likely to the above items or acts that Our Company deems inappropriate

If any of the items in the preceding paragraph apply, Our Company may suspend the Member's use of this Service.

Article 10 (Interruption or cancellation of this Service)

Our Company may suspend or discontinue the provision of the Service or individual contents on this Site without prior notice. Our Company shall not be liable in any way for any damages resulting from such suspension or discontinuation.

Article 11 (Abolition of this Service)

Our Company may discontinue all or part of the Service by notifying the member one month in advance in the manner prescribed by Our Company. Our Company shall not be held responsible for any consequences of the termination of this Service.

Article 12 (Withdrawal)

A member may withdraw from membership by following the withdrawal procedures prescribed by Our Company.

Article 13 (Disclaimer)

Our Company does not guarantee the accuracy, usefulness, certainty, safety, or any other aspect of the Contents on this Site. Our Company will not be held responsible for any damage caused by the use or inability to use the Content of this Site.
Our Company may change or delete the Contents and URLs on this Site without prior notice. Any information on this Site does not always reflect the latest information.
Our Company shall not be held responsible for any damages incurred by Members in relation to the Site through the using of the Service, except in cases of intentional or gross negligence on the part of Our Company.

Article 14 (Revision of these Terms)

Our Company may revise these Terms without the consent of the Member. If Our Company revises these Terms and Conditions, Our Company will notify the Member by a method (including posting on this Site) that We deems appropriate.
Members who continue to use this Site and this service after the notification in the preceding paragraph shall be deemed to have agreed to the revision of these Terms of Use.

Article 15 (Prohibition of Transfer of Rights)

Based on this agreement, Members shall not transfer all or part of their rights and obligations to a third party, including the use of this Service.

Article 16 (Severability)

Even if any provision or part of these Term of Use is determined to be invalid or unenforceable under applicable laws and regulations, the remaining provisions of these Terms of Use shall remain in full force and effect.

Article 17 (Priority of Specific Terms, etc.)

Regarding Services and Contents of this Service that have their own Terms of Use and Terms of Use (including individual detailed rules formulated accompanying them, hereinafter referred to as “Unique Terms”) separately from these Terms of Use, the Unique Terms shall prevail.

Article 18 (Governing Law and Court of Jurisdiction)

The interpretation and application of these Terms shall be governed by the laws of Singapore. In addition, the Singapore District Court shall be the exclusive jurisdictional court of first instance for all disputes relating to this Site and Our Service.
